Dr. Whitney requests the FL Supreme Court to review the 5th District Appeals Court decision regarding a lawsuit from a botched abortion patient. The patient sued Whitney after he botched her abortion, causing her baby to suffer significant physical and mental damage.

May 30, 2008, Synopsis: Abortion patient C.H. sued abortionist Randall B. Whitney for malpractice after he botched her abortion, which caused her baby to be born prematurely and suffer permanent physical and mental injuries, disability, and disfigurement. C.H. sued for malpractice, but the lower court ruled in favor of the abortionist. In this decision, the FL Appeals Court reversed the lower court decision, and ruled in favor of the botched abortion patient.

The FL Dept of Health requests that the Board of Medicine take disciplinary action against Randall Whitney for intentionally striking a patient under his care. (Dr. Whitney was found guilty of one count of misdemeanor battery.)
