Malpractice lawsuit against abortionist Judith Kelsey. On July 10, 1982, Kelsey botched two abortion attempts on patient Denise Draggist, aka Denise Shirk. The patient suffered bleeding and cramping for weeks after the botched abortions. Despite her continuing symptoms, the clinic told Denise she could not possibly be pregnant. On September 27, her symptoms worsened, and she went into premature labor. Denise was rushed to the hospital by a family member, where she gave birth to a 24-week-old baby boy. The baby who had survived two abortion attempts lived for 90 minutes after birth. In court testimony, Denise Shirk described how losing her son caused her great emotional distress, recurring nightmares, and stress to her marriage and family life. She sued abortionist Judith Kelsey for malpractice. A jury awarded negligence damages of $300,000 and punitive damages of $300,000 to the bereaved mother. See pages 1-3.
