2017-01-30 Complaint -- Samantha Bates v. Amy Cousins
In July 2014, plaintiff Samantha Bates, an inmate at Broome County Jail, went to Dr. Amy Cousins to have an abortion. For weeks after the abortion, however, Samantha continued to have abdominal pain and her abdomen grew larger. On Oct 1, she went back to Dr. Cousins for an exam. Dr. Cousins determined that she had failed to complete the abortion and Samantha was still pregnant. The doctor also informed Samantha that due to the failed abortion and subsequent pain medication that Samantha was prescribed, Samantha's baby might have complications, a missing limb, etc. Dr. Cousins said it was too late in the pregnancy for Samantha to have another abortion. Samantha had to continue the pregnancy while worrying that her baby had been injured and wondering who would take care of her baby while she was incarcerated. On Oct. 19, 2014, when Samantha was 22-23 weeks pregnant, she gave birth to a baby boy -- who died after only a few breaths. The hospital then informed Samantha that the failed abortion had lacerated her uterus, and she had been bleeding throughout the pregnancy. Samantha required surgery and 41 staples to save her uterus. Samantha sued Dr. Amy Cousins for emotional anguish, trauma, pain, and injuries caused by Dr. Cousins failed abortion. See pages 2-5. -
