On April 6, 1996, Rosa Acuna, a mother of two young children, visited her ob/gyn doctor because of abdominal pain in her pregnancy.  Dr. Sheldon Turkish determined Acuna was 7 weeks pregnant, and recommended an abortion due to Acuna’s kidney problems.  Acuna asked Dr. Turkish if “the baby was already there,” and the doctor replied, “Don’t be stupid, it’s only blood.”  Turkish botched the abortion procedure, and Acuna was later admitted to the hospital with heavy bleeding.  A D&C was performed, and the nurse told Acuna “the doctor had left parts of the baby inside of you.”  Rosa Acuna was greatly distressed upon realizing her living fetus had been destroyed.  After researching fetal development, she sued Dr. Turkish for medical malpractice, emotional distress, and lack of informed consent.
