Lawsuit by plantiffs including Vinod Goyal and Vijay Goyal, alleging fraud and embezzlement by con artists. The doctors allege that the con artists created bogus companies, and embezzled thousands of dollars of insurance payments from the Goyal's respective businesses. Defendants' motion to dismiss is granted.

Plaintiffs Vinod Goyal and Vijay Goyal sue their bank, stating that con artists duped the bank into paying giant sums of the plaintiffs' insurance payments to fake recipients. The doctors allege that the con artists created bogus companies, and embezzled thousands of dollars of insurance payments which belonged to the Goyal's respective businesses. The appellate court ruled that Vijay and Vinod Goyal, since they had already sued the depository bank over the forged checks, they were estopped from also suing the drawer of the check and the drawee bank that paid the face value of the check to the depository bank.
