Inspection on Feb 13, 2013 for complaint related to Feb 7, 2013 PATIENT DEATH of Jennifer Morbelli. At the time of survey, the clinic was in compliance in regards to the SPECIFIC detail. However, the same day, the inspectors found MULTIPLE violations and non-compliance at the clinic in several areas. See other report.

Inspection on Feb. 13, 2013 (same time as the Complaint Survey) noted multiple health code violations, including: nursing staff does not have experience and training to demonstrate competency in administering or monitor IV sedation; 7 staff members not trained in emergency transfer of patients to hospital; one "RN" managing medicines with an EXPIRED license Jan 2012; physician does not have appointment paperwork or reappointment papers to work at clinic, as required by law; physician missing documentation or data from the National Practitioner Data Bank; 10 of 10 patient records missing discharge diagnosis; no policy to train staff in the emergency transfer of a patient to the hospital; medication vials not properly used or labeled; single-dose vials USED AS MULTI-DOSE VIALS for multiple patients; dirty surgical instruments not properly sanitized or sterilized.

Responding to a patient's complaint. By the time the survey happened, the clinic had come into compliance on that particular issue.

Failed to maintain current lab permit as required by law. Failed to ensure that employees were proficient in Rh factor testing and failed to display current lab permit (had one from 2013, but was non-compliant for TWO YEARS without permits: 2014, 2015).

Found to be in compliance by a PHONE CALL "survey" of the facility. (How can a facility survey inspection happen by phone? And how can a complaint be properly investigated without looking on-site?)

Responding to a complaint. At the time of survey, the clinic had come into compliance in that specific detail.

Violations found in DEFICIENCY IN PATIENT CARE. Five records were reviewed, and the clinic and staff were given opportunity to correct the records. FIVE OF SIX personnel were found not competent or trained for IV care even though they administered IVs, and the Medical Assistant was not sufficiently trained.

Result of a complaint. At time of review, clinic was already in compliance in regard to the SPECIFIC area of the complaint.

The 911 police report from June 2012 lists forty-one (41) emergency calls for police issues during a twenty-month period.

Maryland authorities are investigating the death of 29-year-old Jennifer Morbelli, a kindergarten teacher from New Rochelle, NY, who died on February 7, 2013, after a 33-week abortion at Germantown Reproductive Health Services in Germantown, MD.

Malpractice/negligence suit filed by a late-term abortion patient against Carhart and Germantown Reproductive Health Services for severe injuries, including a uterus that was ripped open from top to bottom. Alleges she may never bear another child due to injuries.
