Kelly was 32-years old when she and her husband went to Hillcrest Women’s Medical Center in Harrisburg, Pennsylvania on June 19, 1996 for an 8th week abortion. Her doctor for the abortion that day was Delhi Thweatt, M.D., and he was told that Kelly was asthmatic and allergic to the “caine” medicines which includes Lidocaine. Despite this knowledge, at about 11:00 a.m., she was given the local anesthetic Lidocaine anyway. She immediately began having difficulty breathing, but the abortion was performed. In fact, an ambulance was not called for more than 15 minutes after she began having breathing difficulties. Paramedics arrived within 5 minutes of the call, and found Kelly in full respiratory arrest. She was transported to Polyclinic Medical Center and placed in ICU. Her condition never improved, and she was pronounced dead on June 22, 1996. She left behind two children. (Dauphin County (PA) Court of Common Pleas, Civil Action # 6070 S96)
