Appellate decision that upheld $730,000 judgment against Fruiterman for malpractice/wrongful birth. -
Granata v. Fruiterman (appeal)
2008 malpractice/wrongful birth suit in which it was alleged that Fruiterman failed to perform a certain first trimester test for Down Syndrome on a pregnant patient. The woman he treated ended up giving birth to identical twins, both with Down Syndrome. The mother tragically alleged she would have received a double abortion, had she known their conditions. Appeals court reversed lower court decision, and cleared Fruiterman of wrongdoing. -
